Michael Biel's point about "abandoned copyrights" is well-taken. I've
supported such a practical approach to the issue myself, especially as it
applies to computer software. In the software world, the term "abandonware"
is used to describe this type of product.
Here's an interesting twist. In common law, "adverse possession," also known
as "squatter rights," can and does lead to a property owner losing control
over how their property is used, although they may retain true ownership.
Example, people use a path across a vacant lot for many years. When the
owner decides to build on the lot, they may have to allow people to continue
to use that path.
It would be interesting to see if copyrighted works could be brought under
the adverse possession laws that cover real property. In the world of OTR,
the materials have been traded openly for a generation and, with few
exceptions, the copyright holders have not exerted their rights.

Mozart died in poverty while
his compositions were being played all over Europe
Many myths have been propagated concerning Mozart including his earnings.
Many consider the biography by Maynard Solomon to be the best if not the
definitive detailing of Mozart's life but for detailing his earnings.
His book starts in an odd way. Before the introduction Solomon writes this:
"Table of Money Values
1 florin [or gulden] = 60 dreuzer
1 ducat = 4 1/2 florins
1 friedrich d'or = 7 to 8 florin
1 sequin = [removed] florins
2 English shillings = 1 florin
1 English pound = 10 florins
1 louis d'or = 9 to 10 florins
Rates vary somewhat owing to currency fluctuations."
At the time I started to read the biography about a musician and composer,
it seemed odd to start talking about money. But in fact money and music are
the unifying elements of the book. And the search for making a living were
central to his activities.
Unlike most composers of the day, Mozart was a freelancer. He was not tied
to a nobleman such as Hayden was.
There is a surprising amount of documentation concerning his earnings.
Solomon details this in his book and it is well worth the read.
At Mozart's death his estimated earnings for 1791 from 3,672 to 5,672
florins. Looking at his earnings over the previous 10 years his last year
was the
highest. He died in debt, it is true. But it was not the lack of earnings
that caused the debt but excessive spending.
In short he died in debt not because of copyright or lack of copyright but
because he was a spendthrift.
